Terms & Conditions​

Thank you for choosing The Messy Baking Co. Please read these Terms and Conditions carefully. By submitting your Inquiry Form, you agree to be bound by the following:

1. Delivery, Set-Up, & Pick-Up

  • Delivery is only offered to established event venues - no residential areas, rental cabins, etc. are eligible for delivery. Delivery fees are based on the distance from our kitchen to your event location and will be confirmed upon booking.

  • You must provide a stable, level surface for dessert display, preferably against a wall, in air conditioning, and out of direct sunlight to ensure safety and quality.

  • Once desserts are delivered or picked up, responsibility for their care transfers to you. We are not liable for any damage caused by table bumps, children, temperature, weather, or other unforeseen circumstances after delivery.

  • Late pick-ups may result in fees or rescheduling. No refunds will be given for failure to pick up desserts.

  • For weddings, delivery is generally one hour prior to the ceremony, but this may vary based on venue and event schedule. Storage in venue refrigeration can be arranged if pre-approved and cleaned before arrival. We are not responsible for damage occurring while moving desserts from storage to display.

2. Outdoor Conditions

  • We recommend storing desserts in a cool, preferably air-conditioned environment.

  • We are not responsible for damage caused by heat, humidity, insects, or weather conditions.

  • Avoid displaying desserts in direct sunlight, as they may melt.

3. Design, Decorations & Stands

  • For birthdays and other occasions: we can supply decorations such as cake toppers if there is ample time to do so for an additional cost.

  • For weddings: we do not supply flowers, toppers, cake stands, or decorations. These must be provided by you and approved by us before the event.

  • We reserve the right to refuse use of unsafe or unsuitable decorations.

  • For pick-ups such as elopements, you can bring flowers for us to add to your cake at pick-up.

  • Decorations should be ready at delivery; if unavailable, we will attempt to contact you or your coordinator. If unreachable, responsibility for decorations transfers to you.

4. Substitutions & Artistic Variations

  • Slight variations from inspiration photos may occur due to the artistic nature of baking and decorating.

  • Ingredient or decoration substitutions may be made with comparable quality items if necessary, and we will inform you when possible.

5. Structural & Safety Notice

  • Tiered cakes are supported with food-safe dowels and/or straws which should not be ingested or tampered with.

  • For safety, please do not allow guests to lift or smash cakes.

  • When transporting tiered cakes, place securely in your vehicle as instructed to avoid injury or damage.

6. Client Responsibilities

  • You are responsible for providing accurate and up-to-date event details including venue address, timing, and contact information.

  • Any changes must be communicated promptly.

  • Ensure timely venue access for delivery and setup. We are not liable for delays caused by lack of access.

7. Payment Terms

  • All orders must be paid for before cake or other desserts are picked up/delivered. 

  • For birthdays and other occasions: payment is due in full - due dates will be added to your invoice. Failure to pay by due date may result in cancellation of your order. 

  • For weddings: non-refundable 50% retainer is required to secure your date. The remaining balance is due no later than 4 weeks before your event.

  • Failure to pay on time may result in order cancellation without refund.

  • Payment plans can be arranged upon request.

8. Changes to Your Order

  • Changes may be requested up to 2 weeks before the event and are subject to approval and potential additional fees.

  • Not all changes can be accommodated depending on timing and complexity.

9. Allergies

  • Our kitchen handles common allergens including milk, eggs, nuts, soy, wheat, and gluten.

  • Cross-contamination is possible despite precautions.

  • We are not responsible for allergic reactions. Please label desserts to inform guests of allergens.

10. Photography & Marketing Use

  • We may photograph your cake and desserts for marketing, social media, and portfolio use.

  • Identifiable faces will not be posted without prior consent.

  • You may request that photos from your event not be shared publicly.

  • Photos of your cake and desserts will not be posted until after your event has taken place.

11. Refunds, Complaints & Returns

  • Contact us within 48 hours after your event for any complaints. Complaints must come from the person who placed the order.

  • We may request product return within 24 hours for review.

  • Refunds, if any, will be proportional to returned products and only if quality standards are not met.

  • No refunds will be issued for taste preferences or failure to follow care instructions.

  • Refunds will not exceed the original purchase price.

  • If you feel we have not lived up to our standards, we want to hear from you and resolve the issue as quickly as possible. We kindly ask that you contact us directly before posting negative reviews or public comments online. Constructive, respectful communication allows us the chance to address your concerns and offer a fair resolution. Public complaints or defamatory statements made prior to contacting us may affect eligibility for a refund or other compensation.

  • Initiating a chargeback without first attempting to resolve the issue directly with us is considered a breach of these Terms & Conditions. We reserve the right to dispute any chargebacks, and if legal action is required, the client will be responsible for all associated fees, including but not limited to legal costs, court filing fees, and recovery expenses. In cases of fraudulent or unjustified chargebacks, we reserve the right to seek damages, including reimbursement of the original order total plus any applicable fees.

12. Liability & Third-Party Handling

  • We are not responsible for damages caused by third parties, including venue staff, other vendors, or guests.

  • Once desserts leave our possession and are handled by others, liability transfers to you.

13. Force Majeure (Acts of God)

  • We are not liable for failure to fulfill orders due to events beyond our control, including but not limited to natural disasters, pandemics, government restrictions, war, civil unrest, transportation disruptions, supply chain issues, or personal emergencies.

  • We will notify you promptly and attempt to provide alternatives such as rescheduling or vendor referrals.

  • Refunds may be provided at our discretion and only if failure is due to our fault or negligence.

  • We are not liable for any additional costs or losses due to such event
